What is outstaffing and the main features
Abroad, the phenomenon of outstaffing personnel (from the English outstaffing - removal of personnel from the state)has long gained wide popularity. Many companies in the West, including the largest, prefer this scheme of interaction with personnel.
The meaning of personnel outstaffing is simple: a company (as a rule, a large one), wanting to focus on the main business and not be distracted by various HR problems, concludes a contract with an employment agency that provides staff. The latter is legally their employer and resolves all issues related to the selection, salary and registration of subordinates. She also maintains all documentation (accounting and personnel).
At the same time, the employees work full-time at the customer's company, but are employed by the provider company. The mediator takes over the functions of salary payment, tax payment, implementation of labor legislation (recruitment, sick leave, dismissal, etc.). At the same time, all of their working time employees are engaged in projects for the client company. The staff is also under the direct supervision of its managers, which is one of the main differences between such a service and outsourcing.
People work in the same way as full-time, full-time employees. They perform their usual duties, even in the office of the client company. But without unnecessary legal difficulties and the risk of costs. If the employee is not suitable, the outstaffer simply replaces him for free, so no one has to be fired.
Legal side
The relationship between the outstaffer and the client company that needs employees is formalized through a staffing agreement.
All conditions under which an employee is accepted come from the customer. He sets their wages, appoints a supervisor and compensations. The task of an outstaffer is to find good personnel who would always be ready to solve the various needs of clients.
Personnel and accounting records are maintained for employees, strictly within the limits of local legislation. An employment contract is concluded between the outsourcing company and each employee. It can be urgent (only for the duration of the contract for the provision of staff to the customer) or indefinite - if the specialist is very valuable and it is assumed that he will be constantly provided with work.
Taxes
Outstaffing personnel is not a tax avoidance scheme, but a completely legal mechanism for optimizing company costs. Taxes on employees are actually paid by the person to whom it belongs: the organization in which the employee is employed (that is, the outstaffer provider). The amount of taxes is simply included in the costs borne by the customer company when concluding a contract with the provider.
So that such claims do not arise, the customer needs to conclude a contract only with an experienced and proven organization that provides services not only to him, but also to a wide range of different companies.
Today, in times of crisis, it is especially important to be alert. Many companies are now trying to survive by attracting clients from outstaffing or staff leasing. At the same time, they do not have sufficient experience, legal support and knowledge of local legislation in the field of personnel administration. All this can lead to unpleasant consequences for the customer.
Therefore, it is very important to cooperate with reliable and proven companies that can organize high-quality recruitment in Poland and solve all potential problems. In this case, the productivity of the company and the quality of the personnel will be much higher, which will allow to achieve serious results and progress for the business.
